Certified Install Pro Terms

CONSENT & AGREEMENT TO PARTICIPATE IN THE MOEN CERTIFIED INSTALL PRO & PRO FINDER PROGRAM (the “TERMS”)

As a participating member of Club Moen, you are also eligible to participate in the Moen Certified Install Pro and Pro Finder Program. Eligible professionals may earn the Moen Certified Install Pro designation and be included in the Moen Pro Finder by completing video training courses provided by Moen covering information regarding the proper installation, maintenance, and servicing of Moen products.

Installation or plumbing professionals that are Club Moen members and/or their duly licensed professionals are eligible to participate in the Moen Certified Install Pro and Pro Finder Program. After successful completion of training courses designated by Moen by the owner or authorized designee of your plumbing business, your business will earn the designation of a Moen Certified Install Pro. Please see below for more details.

As of the effective date of these Terms, Moen’s Pro Finder will only list companies that have confirmed they have the requisite skill and the willingness to professionally and expertly install Moen products and have taken the requisite training offered by Moen. Moen reserves the right to determine, in its sole discretion, who is eligible for inclusion in the Moen Pro Finder and is designated a Moen Certified Install Pro, taking into account the qualifications of interested installers and service providers and the purpose of the Moen Certified Install Pro and Pro Finder program.

By participating in the Moen Certified Install Pro and Pro Finder program and associated benefits, including being designated as a Moen Certified Install Pro and included in the Moen Pro Finder, I agree on behalf of myself and my company and all participating employees and contractors working for my company (individually and collectively “My Company Installers”) and confirm that:

My Company Installers are willing to install and support Moen products in a residential home.
My Company Installers are appropriately licensed and have sufficient skill and experience to install and support Moen products according to industry best practices and that each has a level of training and experience, including participation in training courses as provided by Moen, to reasonably be designated as a professional or Moen Certified Install Pro.
My Company Installers will not use or hold themselves out as having earned, in promotional materials or otherwise, the Moen Certified Install Pro designation unless I and My Company Installers fulfill the requirements of earning such designation as set forth in these Terms and as determined in Moen’s sole discretion.
My company would like to be listed in the Moen Pro Finder and I am willing to receive communications regarding Club Moen, Moen product information, news and other relevant information from Moen.
On behalf of myself and my company, I grant to Moen, its affiliates and their respective subsidiaries the worldwide, non-exclusive, royalty-free right and license (but not the obligation) to use and publish, in whole or in part:
- My name
- My company name and address
- My company’s website (including the right to link)
- My company’s phone number
- information
I understand that the information gathered about me and/or my company through participation in this program is subject to Moen’s Privacy Policy. LEARN MORE.
I understand that my company can request to be unenrolled from the Moen Pro Finder (in which case I will no longer receive leads or communications regarding the Pro Finder and my organization will no longer be listed in the Pro Finder). To unenroll, please send an email requesting to be unenrolled to clubmoenus@moen.com (please include the name of your organization and your Club Moen username).
To the fullest extent permitted by law, I and my Company will indemnify, defend, and hold harmless Moen, its parent, subsidiaries and affiliates, and each of their respective officers, directors, agents, and employees (individually and collectively, the “Moen Parties”) from and against any loss, liability, claim, demand, damages, expenses or costs (“Claims”) arising out of or related to:
- My or My Company Installers’ breach of any obligation set forth in these Terms;
- My or My Company Installers’ installation, repair, or other actions in connection with servicing Moen products or work in a customer’s residence or other premises; and
- My or My Company Installers’ violation, misappropriation or infringement of any rights of Moen or another third party (including intellectual property rights or privacy rights). I agree to promptly notify the applicable Moen Parties of any third-party Claims, cooperate with Moen Parties in defending such Claims, and pay all fees, costs and expenses associated with defending such Claims (including, but not limited to, attorneys’ fees). I also agree that Moen Parties, at their option, may control the defense or settlement of any third-party Claims

MOEN CERTIFIED INSTALL PRO

As a participating member of Club Moen, you are eligible to participate in video training courses provided by Moen covering information regarding the proper installation, maintenance, and other servicing of Moen products. After successful completion of the Moen-provided training courses by my company’s owner or authorized designee, my company will earn the designation Moen Certified Install Pro. Moen will identify your business as a Moen Certified Install Pro on the Moen Pro Finder and may send you related promotional materials for use with your business. Promotional materials and all intellectual property, including Moen trademarks and copyrights, displayed or incorporated therein shall remain the exclusive property of Moen. You are granted a limited nonexclusive, revocable, non-transferable license to use the Moen Certified Install Pro designation and related promotional materials, as well as incorporated intellectual property, solely in connection with the Club Moen and Moen Certified Install Pro program and subject to these Terms.

Moen reserves sole discretion to grant or terminate Certified Moen Pro designations, which Moen may revoke at any time with or without cause. Upon notice that your designation of a Moen Certified Install Pro has been terminated, you agree to immediately cease marketing and otherwise holding yourself out as a Moen Certified Install Pro and to destroy or cease using all associated promotional material, whether created by Moen or otherwise.

By participating in this program and using the Moen Certified Install Pro designation, you agree that you and your installers have the requisite skill, willingness, and training to professionally and expertly install Moen products in accordance with these Terms. Any failure to comply with these terms shall result in the loss of your Moen Certified Install Pro designation.
